Property Owners Agreement

As a condition of purchase of a lot in Las Mariposas I agree to the following stipulations.

1) I/we have read and understand the document titled LP Development Commitment to Las Mariposas and if there have been any questions or concerns regarding this document they have been answered to my satisfaction..

2) I/We will provide and use off street parking on my lot, and will do my best to keep the parking areas hidden from view of other residents.

3) I/We agree that Calle Las Mariposas will not be used as a storage or prolonged parking of boats, motor homes, vehicles etc.

4) I/we agree to conceal any roof top devices such as water tanks, solar collectors, satellite dishes, propane tanks etc. from view in all directions from other residents.

5) I/We will abide by all city and municipal ordinances regarding building size and heights.

6) I/We understand that sewer, water, electrical and phone hook up infrastructure is accessible at each lot location, however it is my responsibility to pay all necessary hook up fees when utilizing these services.

7) I/We understand that Calle Las Mariposas is a private street and is the responsibility of all property owner in Las Mariposas. I/We further agree to pay an amount equal to $30.00/month paid annually to LP Development for the maintenance of the street and everything between lot lines, to include the street, trees, plantings and any other items meant to benefit the individuals living in Las Mariposas. LP Development agrees to keep accurate accounting of all funds and make this information available to residents upon request. If at some point in time there is any unforeseen maintenance situation which can not be covered by the amount in the account then owners will be notified and asked to agree on an amount necessary to cover the situation.

8)I/We agree that all external lighting will be of non-visual pollution type. Meaning that external lighting will not extend into the lots of other residents causing uncomfortable lighting conditions.

9) I/We agree that if by chance during construction, or any other time any damage that might occur to Calle Mariposa, sidewalks, trees, planting or lighting due to negligence or abuse will be immediately repaired by party causing such damage.
